Terms of Service

A. These Terms of Use (the "Terms") constitute a legally binding agreement between you ("you", "user", or "member") and Suuqa app Marketplace ("Suuqa", "we", "us", or "our"), the operator and administrator of the Suuqa app mobile application and website (the "Platform"). These Terms govern your access to and use of the Platform, including all services, features, tools, content, technologies, and functionalities offered through the Platform.

B. By accessing, browsing, registering, or otherwise using the Platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms, including any future modifications. If you do not accept all of these Terms, then you are not authorized to access or use the Service.

C. Your use of the Platform also signifies your agreement to comply with and be legally bound by our Privacy Policy, which explains how we collect, use, and protect your personal information. Additional guidelines, rules, and terms may apply to certain features or offers made available through the Service, and those are incorporated into these Terms by reference.

D. Suuqa app reserves the right, at its sole discretion, to update, change, or modify any portion of these Terms at any time without prior notice. We may do so to reflect changes in the law, new features, or operational requirements. Your continued use of the Platform following any such changes confirms your acceptance of the updated Terms.

E. It is your responsibility to review these Terms regularly to stay informed about any changes. If you are accessing or using the Platform on behalf of a business or other entity, you represent and warrant that you have the authority to bind that entity to these Terms.

A. All services provided through the Suuqa app Platform are offered strictly on an "as is", "as available", and "with all faults" basis. Suuqa app makes no representations or warranties of any kind, whether express or implied. You agree that your use of the Platform is at your sole risk and discretion.

B. Suuqa app does not own, inspect, or guarantee the quality, safety, legality, or legitimacy of the goods and services listed by users on the Platform. Transactions are conducted directly between users, and Suuqa app shall not be held responsible for any disputes, losses, fraud, or damages arising from those transactions.

C. You are strongly advised to inspect any goods in person before making a payment. You should also ask sellers for proper documentation to confirm that the goods comply with all applicable laws, standards, and regulations.

D. You are solely responsible for your personal safety when engaging in transactions. It is your responsibility to meet in safe, well-lit public locations during daytime hours. Suuqa app is not liable for any risks, harm, or incidents that may occur during or as a result of a transaction.

E. Suuqa app makes no guarantee that any items listed are genuine, functional, or legally allowed for sale or use in your location. We expressly disclaim all liability for any infringement of third-party rights or violation of any law stemming from the posting, selling, or purchase of any item or service via the Platform.

A. In order to access certain features of the Suuqa app platform, users are required to create an account by submitting accurate and complete personal information as prompted during the registration process.

B. You may register for an Account as an individual user, a business, or an authorized representative of a company. By registering on behalf of an organization, you confirm that you have the legal authority to bind that entity to these Terms.

C. Each user is permitted to register only one Account. If Suuqa app identifies multiple accounts being operated by the same individual or from the same device, we may require identity verification or take action to restrict access.

D. You are solely responsible for keeping your Account login credentials confidential. You accept full responsibility for all activity conducted through your Account and agree to notify us immediately of any unauthorized access or suspicious activity.

E. By registering, you represent and warrant that you are at least 18 years old, or that you are using the Service under the supervision and consent of a parent or legal guardian if under the age of majority in your jurisdiction.

F. Suuqa app reserves the right to suspend, restrict, or terminate your Account without prior notice if you violate these Terms, suspicious or potentially fraudulent activity is detected, or your actions pose a risk to the safety or integrity of the Platform.

G. You agree to promptly inform Suuqa app of any breach of security or unauthorized use of your Account. We will not be liable for any loss or damage arising from your failure to protect your login information.

A. The Suuqa app platform is a digital marketplace that allows users to create and publish listings, browse listings posted by other users, and directly communicate with each other. Suuqa app acts solely as a facilitator and does not take part in any transaction between users.

B. Suuqa app does not operate as an importer, manufacturer, distributor, agent, or seller of any products or services listed on the platform. All transactions, agreements, and engagements are made directly between users.

C. Suuqa app reserves the right, without prior notice, to remove or block any listings or user access in cases of compliance with court orders, intellectual property claims, suspected violations of these Terms, or detection of fraudulent or inappropriate listings.

D. Suuqa app is under no obligation to justify the removal or blocking of any user-generated content, and such actions may be taken at Suuqa's sole discretion.

E. Suuqa app retains the right to modify, update, limit, or suspend any feature of the Service at any time without prior notice. Users agree that Suuqa app bears no responsibility or liability for any impact, loss, or disruption resulting from such actions.

A. By using the Suuqa app platform, you agree to behave in a lawful, respectful, and honest manner. You are solely responsible for your actions, content, and interactions on the platform.

B. You may not post or promote illegal, harmful, or misleading content, including counterfeit items, stolen goods, adult materials, or any products or services that violate local or international laws. Fraudulent listings, false advertising, or attempts to deceive other users are strictly prohibited.

C. Harassment, discrimination, threats, or abusive behavior toward other users is strictly prohibited. You must not impersonate others, spam the platform, or misuse features in a way that disrupts the experience for others.

D. Suuqa app reserves the right to remove any content, restrict access, or ban accounts that violate these rules. We encourage users to report inappropriate behavior through the platform's reporting tools or by contacting our support team.

A. Users retain full ownership of the content they post on Suuqa app, including images, descriptions, and any other materials submitted through their listings or profiles.

B. By submitting or posting content on Suuqa app, you grant us a non-exclusive, worldwide, royalty-free, transferable license to use, reproduce, modify, publicly display, distribute, and promote your content within the platform and in Suuqa's marketing efforts.

C. Suuqa app does not claim responsibility for user-generated content and is not obligated to monitor, screen, or edit any user submissions. However, we reserve the right to remove or disable access to content that violates these Terms.

D. By using the platform, you acknowledge and accept that your listings and related content may appear publicly and be shared both within the Suuqa app platform and externally as part of promotional or operational activities.

A. Access to and use of the Suuqa app platform is currently free of charge for all users. You may browse listings, post items, and communicate with other users without paying any fees.

B. In the future, Suuqa app may introduce optional paid features such as premium listings, verified badges, promoted posts, or subscription packages. Participation in any paid service will be entirely voluntary.

C. If and when paid features are introduced, users will be responsible for providing accurate payment information. All fees will be processed through trusted third-party payment providers.

D. Suuqa app reserves the right to modify pricing, add or discontinue services, or apply promotions at any time. We may also introduce payment systems commonly used in Somalia, such as EVC Plus, to accommodate local preferences.

A. To the fullest extent permitted by applicable law, Suuqa app shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your access to or use of the platform.

B. Suuqa app serves solely as a facilitator, connecting buyers and sellers. We are not responsible for disputes, failed transactions, product defects, service issues, or user conduct, including fraud or misrepresentation. All interactions and transactions are conducted at your own risk.

C. We do not warrant that the platform will be uninterrupted, secure, or free from viruses or other harmful components. Suuqa app cannot be held liable for any damage to your device, data, or personal information.

D. In jurisdictions where limitations on liability are restricted by law, Suuqa's liability will be limited to the maximum extent permitted.

A. Suuqa app reserves the right to suspend, deactivate, or permanently terminate your account or restrict your access to any part of the Platform at our sole discretion, with or without prior notice.

B. Accounts may be suspended or removed due to repeated reports of misconduct, posting of prohibited or misleading content, use of automated tools or bots, harassment or abuse of other users, and involvement in scams or deceptive transactions.

C. Users who believe their account was suspended or terminated in error may contact Suuqa's support team to request a review. However, we make no guarantees of reinstatement.

D. Upon termination, you will lose access to all features of the Platform associated with your account. Suuqa app is under no obligation to store or recover any user data after termination.

A. These Terms and any dispute or claim arising out of or in connection with your use of the Suuqa app platform shall be governed by and interpreted in accordance with the applicable laws of the Federal Republic of Somalia.

B. In the event of any disagreement, dispute, or claim, both parties agree to attempt to resolve the matter amicably through direct negotiation before pursuing any legal remedies.

C. If a resolution cannot be reached through negotiation, the dispute shall be submitted to a recognized arbitration body or court within Somalia, preferably in Mogadishu, unless otherwise agreed upon by both parties.

D. By accepting these Terms, you waive any right to pursue claims in any jurisdiction outside of Somalia and agree not to initiate or participate in any class action lawsuits or collective claims against Suuqa app.

A. Suuqa app reserves the right to modify, enhance, update, or discontinue any part of the Platform, including features, categories, services, design, or user interface, at any time and for any reason without prior notice.

B. We may introduce new tools or remove existing ones based on user needs and market demands in Somalia or regions where Suuqa app is active.

C. Modifications may also include testing new features, limiting access to certain services, changing listing rules, or adjusting how content is displayed or prioritized.

D. Suuqa app is under no obligation to maintain backward compatibility with older versions of the app or website. Your use of Suuqa app after any modifications means you accept the changes.
